    at the Ontario Regional Office of the Public Health Agency of Canada Rita President of NHU Toronto Local 00009 and Justin were recently awarded the 2014 Ontario Region Health Portfolio Award in the category of Innovation and Creativity In collaboration with researchers from the University of Waterloo Justin and Rita carried out a year long innovative knowledge transfer and exchange research project entitled Living Longer with HIV Characteristics of Persons in Long Term Care and Home Care Populations in Ontario The seminal study represents the first of its kind in Canada HIV and aging has been identified as an emerging trend as both the advancements of HIV treatments and population aging have created a strong demand for more age friendly care and support for people living with HIV The above photo shows Justin and Rita at the centre receiving their well earned recognition Congratulations to both these NHU members on their accomplishment Federal Court ruling equates employer harassment with workplace violence Posted December 15 2014 Employer harassment of NHU members in recent years has been persistent and widespread Given this matter of great concern a recent decision by the Federal Court is a welcome and powerful intervention The Federal Court decision handed down November 13 ruled that employer harassment can constitute workplace violence under the Canada Occupational Health and Safety Regulations of the Canada Labour Code In his ruling the Honourable Mr Justice Manson also clarified whether the employer itself can be viewed as a competent person under the Regulations to investigate complaints of work place violence and if not at what stage of the complaint process such a competent person must be involved The Court was hearing an application for judicial review of a decision taken last January 27 by an Appeals Officer of the Occupational Health and Safety Tribunal of Canada The Appeals Officer had rescinded a Direction issued by a Health and Safety Officer HSO This case is particularly important as it is the first instance of the Tribunal interpreting the definition of work place violence and the process to be followed under section 20 9 of the Regulations The facts of the case before the Court were as follows In late 2011 a worker employed the Canadian Food Inspection Agency in Saskatchewan complained both verbally and in writing of employer harassment The member alleged miscommunication favouritism humiliation unfair treatment and a lack of respect by his supervisor In January 2012 the CFIA Regional Director was asked by the employer to undertake a fact finding review of the concerns raised by the member in his complaint A month later after conducting an internal investigation the Regional Director concluded that while there were communication issues and unresolved tension between the member and his supervisor there was no evidence of harassment and therefore no further investigation was warranted The member immediately requested that a Health and Safety Officer HSO investigate his complaint in accordance with subsection 20 9 3 of the Regulations contending that the CFIA Regional Director was
